The European Union (Withdrawal) (No. 2) Act 2019 requires the Prime Minister to ask for an extension unless Parliament has agreed a withdrawal agreement; or agreed to leave without one.

So, in oral questions to the Attorney General on Thursday 3 October 2019, I asked him to confirm that if Parliament has either not agreed to a withdrawal agreement, or not agreed to leave without one, the Prime Minister would be acting unlawfully if he took us out of the EU on 31 October anyway. It required a simple yes or no answer.
